Types of NGO

There are three types of NGOs, each regulated by different laws:

  1. Section 8 Company under the Companies Act, 2013

  2. Trust under the Trust Act, 1882

  3. Society under the Societies Registration Act, 1860

Trust Registration

NGO Registration – requirements

Trust Registration

  1. Minimum two members are required for registration of Trust

  2. The object of the Trust must be for charitable or social welfare only

  3. All the members must be the resident of India

  4. Registered office address

Section 8 Company Registration

  1. Minimum 2 directors for the incorporation of Section 8 company as a private limited company

  2.  Minimum 3 directors for registration of Section 8 company as a public limited company

  3. At least one director should be the resident of India

  4. Registered office address

  5. The objective of the company should be for a charitable or social purpose only

  6. The profit earned cannot be shared among shareholders

Society Registration

  1. Minimum nine members are required

  2. At least three members to act as president, secretary and treasurer.

What is needed to register an NGO?

How to name a Section 8 Company?

Name of a Section 8 Company (NGO) should not include the words Private Limited (Pvt. Ltd.) or Limited (Ltd.) at the end of its name. The proposed name of a Section 8 Company shall include either of the words - Foundation / Forum / Association / Federation / Chambers / Confederation / Council / Electoral Trust as per Rule 8A(1)(u) of Companies (Incorporation) Fifth Amendment Rules, 2019.

Can a single person start an NGO?

No, a single person cannot start an NGO. Minimum two people are required for Section 8 company incorporation, and at least three people are required for Trust and Society registration.
